As somebody already pointed out (I forgot who), the first test’s a no-brainer since everything that runs on a computer is automatically “tied to a particular machine or apparatus.“ The second one’s a wee bit harder to beat but I think it’s porous enough so that we can rely on watching our usual hordes of legal weasels learn some new and mind-bending contortion tricks in no time. This ruling just doesn’t cut it. It’s not going far enough, and when it comes to litigations, “not far enough” equals “not there.”
